General Terms and Conditions

Last updated: 28.10.2026

1. Scope

The following General Terms and Conditions apply to all orders placed via our online shops (in particular www.sk-motorsport.de and www.ecuheld.de). Our online shops are aimed at consumers and traders (e.g. workshops and companies). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession. A trader is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business or self-employed profession.

In relation to traders, these General Terms and Conditions also apply to future business relationships without our having to refer to them again. Deviating or supplementary terms of the customer shall not become part of the contract unless we expressly agree to their validity. Provisions in these General Terms and Conditions that expressly apply only to consumers or only to traders are marked accordingly.

2. Contracting party, conclusion of the contract

The purchase contract is concluded with SK-Motorsport GbR, Zu Hildringhausen 11b, 57462 Olpe, Germany.

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalogue. You can initially place our products in the basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the ordering process. By clicking the order button, you place a binding order for the goods contained in the basket. Confirmation of receipt of your order is sent by e-mail immediately after the order has been submitted.

When the contract with us is concluded depends on the payment method you choose:

Payment in advance
We accept your order by sending a declaration of acceptance in a separate e-mail within two days, in which we provide you with our bank details.

PayPal and payment methods offered via PayPal (e.g. credit or debit card, SEPA direct debit, Pay Later, Apple Pay, Google Pay and country-specific payment methods)
After placing your order, you will be redirected to the website or the payment screen of the payment service provider PayPal, where you enter your payment details and confirm the payment instruction. The contract with us is concluded upon confirmation of the payment instruction.

Cash payment on collection
A contract with us is concluded as soon as the amount has been paid in cash.

3. Contract language, storage of the contract text

The language available for concluding the contract is German. We store the contract text and send you the order details and our General Terms and Conditions by e-mail. You can view the contract text in our customer login.

4. Delivery terms

Shipping costs are charged in addition to the stated product prices. Further details on the amount of the shipping costs can be found with the offers and in the ordering process. We deliver to the countries offered in the ordering process.

5. Payment

The payment methods available are shown to you in the ordering process. In principle, we offer:

Payment in advance
If you select payment in advance, we will provide you with our bank details in a separate e-mail and deliver the goods once payment has been received.

PayPal and payment methods offered via PayPal
Payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. Depending on the payment method, you will be redirected to PayPal or enter your payment details in a PayPal payment screen. To pay with a PayPal account, you must be registered there or register and authenticate yourself with your login details. The payment transaction is carried out immediately after confirmation of the payment instruction. For „Pay Later“, PayPal’s terms and conditions apply in addition. Further information will be provided during the ordering process.

6. Right of withdrawal

Consumers have a statutory right of withdrawal. Details can be found in our withdrawal policy. Traders have no statutory right of withdrawal.

7. Retention of title

The goods remain our property until full payment has been made.

The following additionally applies to traders: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you hereby assign to us in advance all claims arising from such resale – irrespective of any combination or mixing of the goods subject to retention of title with a new item – in the amount of the invoice total, and we accept this assignment. You remain authorised to collect the claims. However, we reserve the right to collect the claims ourselves if you do not properly meet your payment obligations and fall into default of payment.

8. Transport damage

If goods are delivered with obvious transport damage, please complain about such defects to the delivery agent as soon as possible and contact us without delay. Failure to make a complaint or to contact us has no consequences whatsoever for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurer.

The following additionally applies to traders: The risk of accidental loss and accidental deterioration of the goods passes to you as soon as we have handed the goods over to the forwarding agent, the carrier or any other person or institution designated to carry out the shipment. Between merchants, the duty to inspect and give notice of defects set out in § 377 HGB (German Commercial Code) applies.

9. Warranty and guarantees

Unless expressly agreed otherwise below, the statutory liability for defects applies. For used goods: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year from delivery of the goods may be asserted within the statutory limitation period of two years from delivery of the goods.

The following applies to traders by way of derogation: An insignificant defect does not in principle give rise to any claims for defects. In the event of defects, we shall, at our discretion, provide rectification or replacement delivery. The limitation period for claims for defects in respect of newly manufactured goods is one year from the transfer of risk. For used goods, rights and claims on account of defects are excluded in principle. The limitation period for recourse claims under Section 445a BGB (German Civil Code) remains unaffected.

The above restrictions and shortened periods do not apply to claims based on damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty and fraudulent intent,
  • in the event of breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations),
  • within the scope of a guarantee promise, if agreed, or
  • insofar as the Product Liability Act (Produkthaftungsgesetz) applies.

Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.

10. Liability

For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation

  • in the event of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the Product Liability Act (Produkthaftungsgesetz) applies.

In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations), through slight negligence on the part of us, our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

11. Applicable law, place of jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In relation to consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.

If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships with us is our registered place of business in Olpe. The same applies if you have no general place of jurisdiction in Germany or the EU.

12. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
